Course Description

This course explores Indian nation governments, Indian nation dispute resolution systems (tribal courts and peacemaking), use of Indian customs and traditions as law (Indian common law) in modern litigation in tribal courts, tribal sovereign immunity, tribal court practice, and criminal and civil jurisdiction of tribal courts. These topics are explored using the Navajo Nation court system and Navajo common law as study models. Students are expected to understand the history of federal Indian law and policy, including the major doctrines and cases in federal Indian law.
