UNIFORMED SERVICES EMPLOYMENT AND REEMPLOYMENT RIGHTS ACT OF 1994 (USERRA)

Introduction

USERRA, Public Law 103-353, 108 Stat. 3149, 38 U.S.C. §§ 4301 - 4333, is a federal law which gives members and former members of the U.S. armed forces, both active and reserve, the right to go back to a civilian job they held before military service. This 1994 law completely overhauled and replaced previous legislation involving reemployment rights. The Act expanded employment rights, widened protection from discrimination and retaliation, extended to employers a duty to accommodate persons with service connected disabilities, and increased both enforcement and remedies available under the prior law.
