The vast majority of criminal convictions result from plea bargains rather than trial verdicts.  In this course, we will examine the law, theory, and practice of the process of plea bargaining through sentencing.  We will analyze the necessity and constitutionality of plea bargaining, guilty pleas and Arizona/federal sentencing statutes.  We also will evaluate the role of the prosecution, defense, and judge at the plea bargaining and sentencing stages of criminal litigation, including ethical considerations and victim impact.  The class also will be required to attend a change of plea and sentencing hearing at the Pima County Superior Court during the semester.
