Course Description

This course examines the legal issues involved in the transfer, finance, and development of real property. It introduces students to the various mechanisms of land transfer and recording regimens. It also examines various financing mechanisms, such as mortgages and mortgage substitutes, installment land contracts, rights upon default and before foreclosure, and transfers of the lender's interests. Students learn about the rights of the parties in a foreclosure, foreclosure proceedings, and the priorities of creditors in foreclosure.
