ABA National Appellate Advocacy Competition Team Advances to Finals
The team with Erin Ford, Shane Ham, and Danita Ng won their bracket. They will be advancing to the finals in Chicago in April. Due to a quirk of the draw and some bad luck, they argued in the final round against the #1 seed -- a team that included the #1 overall advocate in the competition and had written the #1 brief. It took their very best arguments, and they delivered.
Tommy George, Mike Ivancie, and Brooke Mickelson received second place (out of 32 teams) for their brief. They won their first three arguments handily before being defeated in the semifinals in a very close decision.
The legal issues this year are weighty and interesting: whether a Congressional enactment ending a war (passed over the president’s veto) is an unconstitutional infringement on the President’s Article II powers as commander-in-chief, and whether a suit by members of Congress to enforce that legislation satisfies the Article III case and controversy standing requirement. |
