Prof. Gantz Advises the Dominican Republic Government on Investor-State Disputes

Prof. Gantz visited the Dominican Republic September 14 - 17, 2010 on behalf of the U.S. Agency for International Development and Chemonics, Inc. to discuss with DR officials how they might respond more effectively to actual and potential claims lodged by foreign investors against the Republic. The discussions covered dispute avoidance, alternative dispute resolution mechanisms, and preparations for and conducting the arbitrations. Both foreign investment and the number of investment disputes have increased since the entry into force of the Central American – Dominican Republic – United States Free Trade Agreement in 2006 and a number of bilateral investment treaties in recent years. Because these trends are likely to continue, government officials are committed to improving their administrative mechanisms to assure more efficient treatment of dispute settlement issues.
