Professor Zachary Kramer will speak about employment discrimination law. Lunch will be served

Title VII of the Civil Rights Act prohibits discrimination on the basis of sex. But what does sex mean? Courts have developed a dizzying set of rules interpreting the scope of Title VIIs sex equality project. The rules pivot around the gender-stereotyping theory of sex discrimination, which holds that employers cannot compel employees to perform their sex in accordance with traditional gender norms. My talk will consider the past, present, and future of the gender-stereotyping theory. Why do we need the theory? Has the theory fulfilled its promise? And how should the theory work going forward? To answer these questions, well consider discrimination cases involving butch women, effeminate men, lesbians and gay men, transgender individuals, cross-dressers, working mothers, overweight men and women, among others. These cases raise hard questions about what equality means and how antidiscrimination law should conceive of difference.
